Pre-Lawsuit

Usually a lawsuit is not a complete surprise. Typically, a dispute exists, sometimes with a disgruntled ex-employee, or a competitor or customer. At some point, this party or his attorney makes a demand. Hiring an attorney and keeping track of all documentation concerning the case are key steps at this time. Winning the lawsuit depends on: 1) provable facts and 2) leverage. Attorneys are skilled at developing both. Although a fee agreement will need to be made, and attorneys fees will need to be paid, in all but the smallest lawsuit, you cannot afford not to be represented.
